These Terms & Conditions ("Terms") govern your access to and use of the Nikon Z Flagship Camera Community website (the "Website"), its associated digital platforms, community spaces, forums, and membership services (collectively, the "Platform"), operated by the Nikon Z Flagship Camera Community ("we", "us", "our", or "the Community").

The Community is a voluntary, non-profit photography community of Nikon Z-mount mirrorless camera owners based primarily in India. We are not an official entity of Nikon Corporation or Nikon India Pvt. Ltd., though we maintain a supportive relationship with Nikon India.

By completing the membership application, accessing member-only areas, or submitting any content to this Platform, you affirm that:

• You are at least 16 years of age;
• You have the legal capacity to enter into binding agreements;
• You have read and agree to these Terms in full; and
• You agree to comply with all applicable laws of the Republic of India.

2.1 Eligibility

Membership in the Nikon Z Flagship Camera Community is open to individuals who:

• Own at least one Nikon Z-mount mirrorless camera body;
• Have a genuine passion for photography;
• Are willing to actively participate in and contribute to the community;
• Are India-based residents or Non-Resident Indians (NRIs) with a strong connection to India; and
• Are not currently barred or removed from membership by the Admin Team.

Dealers, commercial tour operators, photography guides, and representatives of competing brands are not eligible for membership.

2.2 Application & Approval

Membership is not automatic. All applications are reviewed by the Membership Committee and decided within 5 business days. The Community reserves the right to accept or decline any application without providing a reason. Submission of an application does not guarantee membership.

Applicants must provide accurate and truthful information. Providing false or misleading information in an application is grounds for immediate rejection or revocation of membership.

2.3 Member Responsibilities

As a member you agree to:

• Use your complete, real, identifiable full name across all community platforms (no aliases, initials, or nicknames);
• Introduce yourself to the community when joining;
• Actively participate — members who are dormant for extended periods may be removed from platforms;
• Comply with all Community Guidelines, the Code of Conduct, and these Terms at all times; and
• Promptly notify the Admin Team of any changes to your eligibility status (e.g., selling your Nikon Z camera).

2.4 Suspension & Termination

The Admin Team reserves the right to suspend, restrict, or permanently terminate any membership at its sole discretion, including (but not limited to) for:

• Violation of these Terms, the Community Guidelines, or the Code of Conduct;
• Providing false information in the membership application;
• Conduct that is harmful, disrespectful, or detrimental to other members or the community;
• Extended periods of inactivity; or
• Loss of eligibility (e.g., no longer owning a Nikon Z camera).

The Admin Team's decision on disciplinary matters shall be final and binding. No correspondence will be entered into regarding specific moderation decisions.

Membership in this community is a privilege, not a right. The right of admission is reserved.

These conduct rules apply across all community platforms including this Website, WhatsApp groups, events, trips, and any other community space. Full details are published on the Community Guidelines page.

3.1 Respectful Communication

• Treat all members with courtesy and respect regardless of skill level, background, or experience.
• No expletives, offensive comments, or jokes that demean individuals, genders, groups, religions, regions, or organisations.
• No harassment of members through private messages. Complaints will result in investigation and potential ban.
• Critique photographs constructively — never attack the individual photographer.

3.2 Prohibited Content

• No political content of any kind, including opinions, commentary, advocacy, satire, or criticism of any political party, government, or public figure.
• No religious content, including beliefs, preaching, debates, or comparative discussions of any faith.
• No forwarding of irrelevant content, chain messages, or material unrelated to photography and the group's purpose.
• No pirated content or material shared without the copyright owner's explicit permission.
• No promotion of personal business interests, commercial services, or third-party brands.
• No brand bashing or disparagement of Nikon as a company.

3.3 Photo Sharing Standards

• When sharing photographs, include EXIF data, camera settings, and technique notes where possible.
• Share only photographs taken with your own Nikon Z gear. Images from other cameras may be shared strictly for reference or comparison purposes with clear attribution.
• Exercise judgement and discretion — content that could offend other members should not be shared.
• Credit original authors when sharing or referencing others' work.

3.4 Confidentiality of Community Discussions

All discussions, feedback, reviews, opinions, and experiences shared within community platforms (including WhatsApp groups) are strictly confidential and intended solely for the awareness and benefit of community members.

• You must not share, forward, screenshot, reproduce, or disclose any group discussions outside the community without the explicit prior consent of the original author(s) and the Admin Team.
• Personal details of members (names, phone numbers, social media handles, private messages) must not be shared with third parties without explicit permission from the member concerned.
• Feedback and reviews of tour operators, guides, or service providers shared within the community are confidential and must not be communicated to those operators or any other third party.
• Breach of confidentiality may result in removal from all platforms and may expose you to legal action by the affected member.

3.5 Language

English is the primary and mandatory language for all community communications. This ensures discussions are inclusive and accessible to members from all regions. Use of regional languages must be accompanied by an English translation in the same message.

4.1 Your Content

When you upload photographs, write-ups, captions, or any other content ("Member Content") to this Platform, you:

• Retain full copyright ownership of your photographs and original creative works;
• Grant the Community a non-exclusive, royalty-free, worldwide licence to display, reproduce, and promote your content on this Website, our social media channels, and community materials (such as newsletters, presentations, or event displays) for the purpose of showcasing community photography and promoting the community; and
• Confirm that you are the original creator of the content and that it does not infringe any third-party rights.

You may request removal of your content from the Platform at any time by writing to nikonzcameragroup@gmail.com. Removal requests will be processed within a reasonable time frame.

4.2 Attribution & Contest Submissions

Contest-winning photographs may be featured prominently on the Website homepage, social media, and community materials. Full attribution (photographer's name and contest placement) will always be given. Submitting an entry to a contest is deemed consent to such use.

4.3 Prohibited Submissions — Own Work Only

Every photograph, video, or piece of creative content uploaded to this Platform must be your own original work captured personally with your own camera equipment. The following are strictly prohibited:

• AI-generated images — photographs, composites, or any visual content created, enhanced, or substantially altered using artificial intelligence tools (including but not limited to Midjourney, DALL·E, Stable Diffusion, Adobe Firefly's generative fill beyond minor corrections, or similar AI image-generation software) are not permitted. This community celebrates authentic, camera-captured photography;
• Others' photographs — uploading, sharing, or submitting work that was photographed by another person, even with their permission, is not allowed unless explicitly approved by the Admin Team for specific educational or reference purposes;
• Watermarked or previously published third-party content — screenshotting or reproducing photographs from social media, stock sites, or any online source;
• Composite images using third-party elements — images where significant portions (skies, backgrounds, subjects) have been replaced with or derived from photographs taken by someone else;
• Content that infringes any copyright, trademark, or other intellectual property right of any person or organisation;
• Content that is obscene, offensive, or defamatory, or that violates any applicable law; or
• Content containing personally identifiable information of third parties without their explicit consent.

4.4 Member's Sole Responsibility for Copyright

By uploading any content to this Platform, you expressly represent and warrant that:

• You are the sole original author and copyright owner of every photograph or piece of content you upload;
• The content does not infringe the intellectual property, privacy, or any other rights of any third party; and
• You have obtained all necessary consents, licences, and permissions required to upload and share the content on this Platform.

4.5 Takedown & Reporting

If you believe that content uploaded by another member infringes your copyright or intellectual property rights, please notify us promptly at nikonzcameragroup@gmail.com with the following information:

• A description of the copyrighted work you claim has been infringed;
• The URL or specific location of the allegedly infringing content on this Website;
• Your name, contact details, and a statement confirming you are the rights holder or authorised to act on their behalf; and
• A declaration that the information in your notice is accurate and made in good faith.

We will review valid notices and take appropriate action, which may include removing the content and taking disciplinary action against the member concerned. Submitting a false or fraudulent takedown notice may itself attract legal consequences.

4.6 Website Content

All original content on this Website — including text, design, logos, and layout — is the property of the Nikon Z Flagship Camera Community and may not be reproduced without written permission. The Nikon name and trademarks belong to Nikon Corporation and are used on this Website for identification purposes only. We are not affiliated with or endorsed by Nikon Corporation in an official capacity.

We are committed to protecting the privacy of our members and applicants. This Privacy Policy explains how we collect, use, store, and protect your personal information. We comply with the applicable data protection principles under the Information Technology Act, 2000 and relevant rules, as well as applicable provisions of the Digital Personal Data Protection Act, 2023 (India).

We collect only the information necessary to operate the community and review membership applications. The table below summarises what we collect and why:

We do not sell, rent, or share your personal information with any third party, advertiser, or commercial entity.

5.3 Who Has Access to Your Data

Your personal data is accessible only to:

• The Admin Team of the Nikon Z Flagship Camera Community, solely for membership management purposes;
• The Membership Committee, during the review of your application; and
• Other community members, to the extent that you voluntarily make information publicly visible (e.g., in the Member Directory).

5.4 Data Security

We take reasonable technical and organisational measures to protect your personal information from unauthorised access, loss, or misuse. However, as this is a community-run platform, we cannot guarantee absolute security and encourage members to exercise appropriate caution in what they share publicly.

5.5 Your Rights

You have the right to:

• Access the personal data we hold about you;
• Correct inaccurate data;
• Request deletion of your personal data (subject to legal obligations);
• Withdraw consent for data processing at any time (which may result in termination of membership); and
• Object to use of your data for any specific purpose.

5.6 Children's Privacy

This Platform is not directed at children under the age of 16. We do not knowingly collect personal data from persons under 16 without verified parental consent. If we become aware that we hold data from an under-16 individual without consent, we will delete it promptly.

This Website uses a small number of cookies and browser storage mechanisms to provide a functional experience. We do not use advertising cookies, third-party tracking cookies, or analytics that identify you personally.

The Community Marketplace ("Marketplace") is a member-only service that allows members to post listings to buy, sell, or rent photography equipment. It is provided as a convenience for members and is governed by the following terms.

7.1 Member-Only Access

The Marketplace is accessible to approved community members only. Listing on the Marketplace is a privilege that may be revoked for any violation of these Terms or the Community Guidelines.

7.2 Permitted Listings

• Members may list only their own photography equipment — not items on behalf of third parties, dealers, or commercial entities.
• All listed items must relate to photography (camera bodies, lenses, accessories, tripods, bags, lighting, filters, etc.).
• Only genuine items in the member's possession may be listed. Listing items you do not own is prohibited.

7.3 Prohibited Listings

• Items owned or sold by dealers, commercial retailers, or tour operators;
• Counterfeit, stolen, or illegally obtained goods;
• Non-photography items; and
• Listings posted on behalf of another person or business.

7.4 Community Disclaimer — Buyer/Renter Beware

7.5 Moderation

All listings are subject to review by the Admin Team before publication. The Admin Team may remove any listing at its sole discretion without notice. Repeated posting of prohibited or misleading listings will result in suspension of Marketplace privileges and potential termination of membership.

8.1 Platform Disclaimer

This Website and Platform are provided "as is", without warranty of any kind, express or implied. We do not guarantee that the Platform will be error-free, continuously available, or free from security vulnerabilities.

8.2 Community Content

Content posted by members (photographs, articles, comments, tips, gear reviews) represents the personal views and experiences of the individual member, not the Community or its administrators. We do not verify, endorse, or warrant the accuracy of any member-posted content.

8.3 Trips & Tours

Information about trips and tours posted by members is shared in good faith for informational purposes only. The Community and its Admin Team do not vouch for, organise, or bear any responsibility for any trip, tour, guide, accommodation, or transportation shared or discussed on the Platform. All travel decisions and arrangements are the sole responsibility of individual members.

8.4 External Links

This Website may contain links to external websites (social media profiles, third-party resources, etc.). We have no control over the content of those sites and accept no responsibility for them.

8.5 Admin Liability

The Admin Team members act as volunteers in their individual capacity. They disclaim any personal liability for the acts, omissions, opinions, or posts of other members. Moderation actions taken by admins are final but do not give rise to any claim or right of action against the individual administrators.

8.6 Maximum Liability

To the fullest extent permitted by applicable law, the total liability of the Community in connection with these Terms or your use of the Platform shall not exceed ₹1,000 (One Thousand Indian Rupees).

8.7 Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of India. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra, India.

The Knowledge Base and Video Library are members-only resources containing articles, training recordings, expert talks, and technical guides contributed by community members and facilitators.

9.1 Member-Only Access

These resources are provided exclusively for community members. Sharing links, content, recordings, or materials from the Knowledge Base or Video Library outside the community is strictly prohibited.

9.2 Recording Consent

Members who participate in recorded sessions (workshops, expert talks, technical webinars) consent to their participation being recorded for internal community use. Recordings are made available in the Video Library exclusively for community members and will not be distributed publicly.

9.3 Usage Restrictions

Knowledge Base and Video Library content must not be:

• Downloaded or stored for personal archiving beyond what is permitted by your browser;
• Shared with non-members or posted on any external platform; or
• Reproduced or republished without the explicit consent of the content creator and the Admin Team.

We reserve the right to update or modify these Terms at any time. When we do, we will:

• Update the "Last Updated" date at the top of this page;
• Post a notice in the community WhatsApp group(s) and on this Website; and
• Where changes are material, send an email notification to all active members.

Your continued use of the Platform or participation in community activities after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must notify us and cease using the Platform.
